Woman Has Right Stay With Estranged Husband’s House: SC

NEW DELHI: The Supreme Court ruled that a woman is entitled to claim the right to stay in a “shared household” where she has been living with her estranged husband even if the premises belong to relatives. 

A bench of Justices Ashok Bhushan, R Subhash Reddy and M R Shah overruled a 2006 judgment and ruled that the conditions mentioned in Section 2(s) (of The Protection of Women From Domestic Violence Act, 2005) are satisfied and the said house will become a shared household” in the event of joint households. 

The ruling came in a case where a Delhi based resident wanted to evict his daughter-in-law from his property. She had been estranged from her husband and filed for divorce due to domestic violence.
